The use of the APP and the benefits of the Programme implies full, unconditional acceptance of all these Terms and Conditions of Use and Operation of the "SALdeCompras" Programme and of the Regulatory Bases governing it.
Responsible Declaration, Authorisation and Acceptance of Terms
I DECLARE under my responsibility:
- That I have read, understand and fully accept the Regulatory Bases of the "SALdeCompras" Programme (V10052026) and the current Voucher Campaign Call, the content of which I am aware of.
- That I meet the requirements set out in the aforementioned Bases to participate as a beneficiary consumer, and in particular:
- I am a natural person.
- I am not subject to any of the prohibitions on obtaining the status of beneficiary established in Article 13 of Law 38/2003, of 17 November, General Grants Act.
- I am up to date with my tax obligations with the State Tax Administration Agency (AEAT), the General Social Security Treasury (TGSS) and the Local Tax Office (OAGER).
- The subsidy I may obtain through the Programme is incompatible with any other subsidy, grant, income or resource for the same eligible expenditure, and I do not receive any such support for said expenditure.
- That I undertake to immediately inform the Municipal Company of any change in compliance with the above requirements or of the subsequent receipt of other incompatible grants for the same expenditure.
I AUTHORISE the Municipal Company for Tourism, Trade and Economic Promotion S.A.U. (hereinafter, the Municipal Company) to verify, at any time during my participation in the Programme, compliance with the declared requirements by means of electronic queries to the AEAT, TGSS and OAGER.
I ACCEPT and UNDERTAKE to:
- Submit to verification and financial control actions by the granting body, the collaborating entity and the competent supervisory bodies, both national and of the European Union.
- Repay the funds received in the event of improper, fraudulent use or failure to meet the required conditions, together with the applicable late-payment interest.
- Retain the supporting documentation for transactions carried out for as long as they may be subject to verification.
I also ACCEPT the processing of my personal data for the purposes of the Programme, under the terms established in the Data Protection clause of these Terms and in the twelfth Base of the Regulatory Bases.
I AUTHORISE the receipt of alerts and notifications via push notification in the SALdeCompras application, as well as its newsletter, from which I may unsubscribe by following the procedure set out in the application itself.
First.- Object and Purpose of the Programme
The Salamanca City Council, through the Municipal Company for Tourism, Trade and Economic Promotion S.A.U., runs the "SALdeCompras" Programme with the aim of encouraging and boosting local proximity commerce in the city of Salamanca, understood as retail commercial establishments with their place of work and registered address in the municipality.
The Programme aims to strengthen the dynamism of Salamanca's commercial sector, raise consumer awareness of the social and economic value of local trade, and encourage shopping tourism in the city.
"SALdeCompras" is a registered trademark that identifies the local commerce dynamisation platform, managed by the Municipal Company.
Second.- Legal Nature of the Programme. Initiatives
The bonuses regulated under the Programme have the nature of a subsidy and are subject to Law 38/2003, of 17 November, General Grants Act, and its implementing regulations. Their management is governed by the principles of publicity, transparency, concurrence, objectivity, equality, non-discrimination, effectiveness and efficiency in the use of public resources.
The bonuses are directed exclusively to consumers, with the adhered commercial establishments acting as collaborating entities under the terms of Article 12 of Law 38/2003.
Programme initiatives may include, among others, digital voucher campaigns, dynamisation activities, draws and training campaigns. Each campaign is implemented through a specific call, which sets out its conditions, amount and duration. Registration in the "SALdeCompras" application constitutes an application to participate in the subsidy Programme, for the purposes of Article 23 of Law 38/2003.
Third.- Conditions for Participating as a Consumer
Natural persons who meet the following requirements may participate as beneficiary consumers:
- Be a natural person.
- Be registered in the "SALdeCompras" Programme via the mobile application.
- Not be subject to any of the prohibitions in Article 13 of Law 38/2003, of 17 November, General Grants Act.
- Be up to date with tax obligations with the AEAT, TGSS and Local Tax Office (OAGER) at the time of registration and throughout participation in the Programme.
- Accept these Terms, the Regulatory Bases and the specific conditions established in each call within the Programme.
- Not receive, for the same eligible expenditure, any other subsidy, grant, income or resource from any public or private body, national, European Union or International Organisation.
The "SALdeCompras" APP is a personal, non-transferable digital means that entitles its holder to access the benefits of each campaign.
Fourth.- Campaign Voucher Scheme Operation
4.1. Obtaining a voucher
To obtain a digital voucher worth €10, the consumer must accumulate purchases totalling €200 or more at adhered establishments. After each purchase, the consumer must:
- Register the transaction in the application immediately after it is made.
- Upload a clear, legible image of the corresponding invoice or receipt.
The establishment must then check and, where applicable, validate each transaction registered by the consumer; the transaction must have "validated" status for the balance to be effective. No balance will be generated without these actions being completed. The maximum amount creditable per individual purchase is €200; any excess does not count towards obtaining vouchers.
4.2. Redeeming a voucher
Once a voucher is available in the APP (identified by a QR code), the consumer may redeem it at any adhered establishment by showing the QR code, which the establishment will scan and register.
- The minimum purchase amount to redeem a voucher is €10.
- Each voucher is redeemed in a single transaction and cannot be split.
- Multiple vouchers may be redeemed in a single purchase, provided the consumer has sufficient balance.
4.3. Per-consumer limits
The maximum subsidy amount per beneficiary consumer is €300 throughout the entire campaign, equivalent to a maximum of 30 vouchers of €10 each, or until the available budget is exhausted.
4.4. Duration and deadlines
- Voucher acquisition: until 31 October 2026, or until the allocated budgetary credit (€150,000) is exhausted, whichever comes first.
- Voucher redemption: until 30 November 2026. Vouchers not redeemed by that date will automatically expire, with no right to reimbursement or compensation.
Fifth.- Consumer Obligations
The beneficiary consumer is subject to the obligations set out in Article 14 of Law 38/2003, and in particular:
- Register each purchase in the application, providing the corresponding invoice or receipt in a clear and legible manner.
- Submit to verification actions carried out by the granting body or the collaborating entity, as well as any other financial control actions by the competent bodies, both national and of the European Union.
- Notify the granting body of the receipt of other incompatible subsidies, grants or resources for the same expenditure, as soon as this becomes known.
- Retain supporting documents for purchases made for as long as they may be subject to verification.
- Repay funds received in the event of proven improper or fraudulent use, or failure to meet required conditions, together with the corresponding late-payment interest.
- Include, where required under personal income tax (IRPF) regulations, the amount of vouchers received in their tax return, as they are considered capital gains, unless a legally provided exemption applies.
Sixth.- Improper or Fraudulent Use
Any improper or fraudulent use, including attempts, of any action contrary to the Regulatory Bases, the call or these Terms, or that constitutes an irregular use of the benefits offered, is prohibited. The following conduct is expressly forbidden:
- Concealing, falsifying or impersonating identity.
- Registering false, inaccurate, incomplete, altered or manipulated transactions.
- Artificially splitting purchases to exceed the set accumulation limits.
- Using vouchers in transactions of less than €10.
- Making purchases at establishments owned by the consumer or where the consumer works as an employee, in order to generate bonuses.
- Any other conduct aimed at improperly obtaining vouchers or subsidies.
In the event of improper or fraudulent use, the Municipal Company may, through a reasoned decision following a hearing, cancel the generated balance, revoke user status, demand repayment of improperly received amounts, and pursue any applicable administrative, civil or criminal liability.
Seventh.- Duration and Withdrawal from the Programme
The "SALdeCompras" Programme has indefinite duration as a general framework. Promotional campaigns have the duration specified in each call.
Consumers may withdraw at any time via the mobile application. Voluntary withdrawal does not exempt from compliance with outstanding obligations or from liability arising from prior improper or fraudulent use.
The Municipal Company may enforce withdrawal by reasoned decision following a hearing, in the event of continuous inactivity for twelve consecutive months or improper or fraudulent use of the Programme.
Eighth.- Limitation of Liability
The Salamanca City Council and the Municipal Company shall not assume any liability for commercial relations, transactions, incidents or conflicts arising between Programme users, as these are strictly private matters, nor shall they be liable for actions of participants unrelated to the Programme's operation.
In the event of loss, theft or robbery of application login credentials, the consumer must notify the Municipal Company immediately.
Ninth.- Amendments
The Salamanca City Council, through the Municipal Company and with prior approval from its Board of Directors, may introduce amendments to these Terms and to the Regulatory Bases. Amendments will be published through legally established channels, on the municipal website and in the mobile application. Users will be notified via push notification of any changes to a call, and continued use of the Programme after publication of a notified amendment will be understood as knowledge and acceptance thereof.
Tenth.- Personal Data Protection
Personal data collected within the "SALdeCompras" Programme will be processed in accordance with Regulation (EU) 2016/679, General Data Protection Regulation (GDPR), and Organic Law 3/2018, of 5 December, on Personal Data Protection and Guarantee of Digital Rights.
The purpose of processing is the management, execution, control and monitoring of Programme campaigns, as well as verification of compliance with requirements, including the use of data in dissemination channels required under the General Grants Act. Data will be retained only for as long as necessary for this purpose and will be deleted once the Programme has ended, unless a legal retention obligation applies.
Users may exercise their rights of access, rectification, erasure, objection, restriction of processing and portability at any time by contacting: contacto@delegado-lopd.es, stating the right they wish to exercise and verifying their identity.
Eleventh.- Competent Bodies and Appeals
- Instructing body: the Municipal Company for Tourism, Trade and Economic Promotion S.A.U.
- Granting body: the Managing Director for Trade of the Municipal Company, who shall issue collective grant decisions, without prejudice to reporting to the Board of Directors.
A complaint against a decision may be submitted to the Municipal Company, whose Board of Directors shall resolve it following a legal or technical report. If resolution is not possible at that level, the Courts of the city of Salamanca shall have jurisdiction.
Twelfth.- Balance Accumulated under the Previous Programme
Any balance accumulated by a consumer who, at the time these Bases come into force, was participating in the "SALdeCompras" Programme, must be used within a maximum period of two months from the date of entry into force, at the redemption centres enabled under the previous procedure. These transitional redemption transactions will not generate new rights under the new Programme. After this period, any unredeemed balance will be automatically considered expired, with no possibility of claiming it or requesting reimbursement or compensation.
Final Provision.- Entry into Force
These Terms enter into force simultaneously with the Regulatory Bases of the "SALdeCompras" Programme (V10052026), that is, the day after their publication in the Official Gazette of the Province of Salamanca (B.O.P.).
For all matters not addressed in these Terms and/or in the event of interpretation or complaint, the Board of Directors of the Municipal Company shall resolve.
Application Terms of Use
Use of the "SALdeCompras" application implies acceptance of these Terms, the Programme's Regulatory Bases and specific campaign calls. The application is a personal, non-transferable digital means for participating in the Programme.
- Use by minors and persons with limited legal capacity. When the application is used by minors or persons with limited legal capacity, their legal representatives are responsible for supervising and ensuring appropriate use, without prejudice to legally applicable liabilities.
- Security and loss of credentials. In the event of loss, theft or unauthorised use of credentials, the user must notify the Municipal Company as soon as possible. The Municipal Company shall not be responsible for improper or fraudulent uses that occurred before such notification, unless attributable to it.
- User identification. Adhered establishments and the Municipal Company may request the user to show their national ID or other valid official identification document, particularly for purchase validations, voucher redemptions or where there are indications of improper or fraudulent use.
- Content uploaded by users and establishments. Consumers and adhered establishments are solely responsible for the truthfulness, accuracy, legibility, appropriateness and lawfulness of documents and files they upload to the application, including invoices, receipts, images or other content. The Municipal Company shall not be responsible for incorrect, inaccurate, illegible, altered, unlawful or inappropriate content uploaded by users or establishments, nor for any damages or liabilities that may arise therefrom.
- Incidents and anomalies. Any incident or anomaly in the registration of purchases, validation of transactions or generation of vouchers must be reported to the relevant establishment or to the Municipal Company for verification and, where applicable, correction.
- Obligation of proper use. Users must use the application diligently and in accordance with the law, refraining from any action contrary to the Bases, calls or these Terms. Any improper or fraudulent use of the Programme is prohibited.
- Application updates and amendments to terms. The Municipal Company may update the application and amend these Terms. Amendments take effect from their publication through legally established channels or through the application or municipal website. Continued use of the application implies acceptance.
- Applicable law and jurisdiction. Spanish law applies. Disputes relating to these Terms or use of the application shall be resolved by the Courts of Salamanca, without prejudice to the mandatory jurisdiction rules applicable to consumers.
